Privacy and Personal Data Processing Policy

1. This Privacy and Personal Data Processing Policy (hereinafter - the “Policy”) regulates the relations between individuals-users of the website (hereinafter - “Users”) vmvdesign.kz (hereinafter - the “Site”) and FE “VMVdesign KZ.”, IIN 87032640089, (hereinafter - the “Operator”) on the processing of personal data of Users and is developed in accordance with the Law of the Republic of Kazakhstan dated May 21, 2013 № 94-V “On personal data and their protection”.

4. Personal data of the Users of the mobile application are collected and processed for the following purposes:
4.1. for negotiating the formation of a commercial offer and possible conclusion of a Service Agreement or other civil law transaction (hereinafter referred to as “Agreement”).
4.2. for identification of the User;
4.3. to automate the process of conclusion of the Contract or other documents necessary for conclusion of the Contract;
4.4. to conduct market research and analytics.
4.5. informing the User by sending e-mails;
4.6. for other purposes stipulated by the legislation of the Republic of Kazakhstan;

5. The Operator has the right to process personal data by the following actions, including, but not limited to: collection, systematization, accumulation, storage, clarification (update, change), use, distribution, blocking, destruction, trans-border transfer on the territory of foreign states (parties to the Council of Europe Convention for the Protection of Individuals with regard to Automatic Processing of Personal Data, other foreign states that provide adequate protection of the rights of personal data subjects and do not provide adequate protection of the rights of personal data subjects and other foreign states that do not provide adequate protection of the rights of personal data subjects).
6. Processing of Personal Data is carried out by the Operator using the following main methods (but not limited to them): storage, recording on electronic media and their storage, labeling, mixed processing of personal data (automated and non-automated).
7. The User consents to the processing of personal data without limitation of time.
8. The Operator is obliged to take the necessary organizational and technical measures to ensure confidentiality, integrity, security and availability of Users' personal data.
9. The Operator is obliged to observe the rights of Users in the field of personal data processing, as well as to comply with other requirements for personal data processing established by the legislation of the Republic of Kazakhstan.
10. The Operator shall ensure the safety of personal data and take all possible measures to exclude access to personal data by unauthorized persons.
11. In case of identification of inaccuracies in personal data, the User may update them independently, by sending a written notice to the Operator to the Operator's address: RK, Almaty, Turksib district. Almaty, Turksib district, Novosibirsk str. 1A with the note “Actualization of personal data”.
12. The period of personal data processing is unlimited. The User may at any time withdraw his/her consent to the processing of personal data by sending a written notice to the Operator at the Operator's address: RK, Almaty, Turksib district, 1A, Novosibirsk str. Almaty, Turksib district, Novosibirsk str. 1A with the note “Withdrawal of consent to processing of personal data”.

14. The User has the right:
14.1. have all necessary rights allowing him/her to use the Site;
14.2. to use their personal data for any lawful purpose, including for the purposes set out in the Policy;
14.3. revoke his/her consent to the collection and processing of data by drawing up an appropriate written document, which can be sent to the Operator's address: RK, Almaty, Turksibsky district, Almaty. Almaty, Turksib district, 1A Novosibirskaya str. In case of withdrawal of consent to processing of personal data, the Operator has the right to continue processing of personal data without consent, when personal data is made publicly available and in the presence of grounds specified in Article 9 of the Law of the Republic of Kazakhstan dated May 21, 2013 № 94-V “On Personal Data and their Protection”.
15. The User is obliged:
15.1. to indicate reliable information about himself/herself in the amounts necessary for the use of the Website and conclusion of the Agreement;
15.2. be familiarized with this Policy;
15.3. to notify the Operator in case of changes in personal data;
15.4. fulfill other obligations in the field of personal data, when such obligations arise for the subject of personal data in the course of processing of his/her personal data.

16. The law of the Republic of Kazakhstan shall apply to this Privacy Policy and relations between the User and the Operator arising in connection with the application of the Privacy Policy.
16.1. The Operator has the right to make changes to this Policy without the User's consent.
16.2 The new Privacy Policy comes into force from the moment of its placement on the Website, unless otherwise provided by the new version of the Privacy Policy.
16.3 The User undertakes to independently follow the changes of the Privacy Policy by familiarizing with the current edition.
